La trama rusa del 'procés' que pone en jaque la ley de amnistía

El sumario del caso 'Voloh' está plagado de nombres propios que podrían quedar fuera de la medida de gracia porque el juez Aguirre ha activado una vía que excluye el perdón para los que "traicionan el Estado" en sus relaciones con potencias extranjeras como Rusia

El sumario del 'caso Voloh' está plagado de nombres propios que podrían quedar fuera de la ley de amnistía tal y como el juez Joaquín Aguirre está delimitando la causa. La investigación de 'Tsunami Democràtic' de la Audiencia Nacional, que también ha puesto en un brete el perdón, se alimentó, precisamente, de las pesquisas que la Guardia Civil realizó en 'Voloh'. Una parte de las diligencias terminaron viajando a la mesa del juez Manuel García Castellón, las relacionadas con los disturbios violentos de 2019. Pero este lunes entró en juego un nuevo ángulo ciego que el Gobierno había dejado fuera de la norma: la trama rusa del procés.

Un complicado entramado por el que líderes independentistas buscaron presuntamente la ayuda del Kremlin para financiarse y declarar la independencia. Durante los meses posteriores al 1-0 se comenzaron a publicar las primeras informaciones sobre la mano de Rusia, pero el entorno independentista las negaba e, incluso, las ridiculizaba. Años después, diferentes investigaciones periodísticas y la causa que lidera el juez Aguirre se han colmado de evidencias que muestran viajes a Moscú y contactos con capos cercanos a Vladímir Putin.

Víctor Terradellas

El exresponsable de Relaciones Internacionales de Convergencia y asesor del expresidente Carles Puigdemont durante el 1-0 está imputado y ha sido uno de los testimonios claves del caso. El juez divide en dos los contactos con Rusia, de forma que en la primera etapa Terradellas era la pieza fundamental hasta que quedó tocado tras su detención en el marco de la 'Operación Estela' y entonces el punto de conexión pasó a ser Josep Lluís Alay.

Su declaración ante Aguirre (el 20 de mayo de 2022) fue muy ilustrativa porque reconoció que había viajado dos veces a Moscú. La última sostuvo que fue en septiembre de 2018, meses después de una conversación que se le incautó en su teléfono móvil en la que dijo que visitaría al FSB (los servicios secretos de Rusia). La instrucción ha acreditado que se trasladó en esa fecha a la capital rusa para entrevistar con Nicolay Sadovnikov, el exdiplomático asesor del Ministerio de Asuntos Exteriores de Rusia, la misma persona que se entrevistó con Puigdemont en octubre del 2017 en su residencia oficial.

En una conversación de más de 40 minutos con el empresario Xavier Vendrell (considerado miembro del 'Estado Mayor' que ayudó al Govern a organizar el referéndum), Terradellas afirma que en los momentos más tensos de 2017, Rusia ofreció 10.000 soldados y a pagar la deuda catalana si Cataluña reconocía a Crimea. En esta charla (que tuvo lugar en mayo de 2018 y que grabó a espaldas de Vendrell) esgrimió que al expresident le dio miedo: "Se cagó (...) dice que no quiere ser responsable de que maten a gente" y no quiere ser responsable".

Josep Lluís Alay

Historiador que comparte abogado con el expresident Puigdemont. En la causa hay decenas de conversaciones entre él y Gonzalo Boye. El juez este lunes apuntó que consta acreditado en los mensajes entre ambos "de manera inequívoca sus contactos con altos dirigentes del Kremlin ya que se refieren a la necesidad de que Puigdemont no critique la labor de Putin respecto al disidente Navalny y que tampoco critique al presidente de Bielorrusia".

Koba Shermazashivili

Sobre ellos también existen viajes para entrevistarse con los más altos capos de la mafia rusa como Zakhar Kalashov, Vasily Khristoforov y Koba Shermazashivili. El juez ubica, incluso a Evegny Primakov en esos encuentros, un político relevante, de peso en el Ejecutivo de Putin.

En una investigación de The New York Times en septiembre de 2021 el propio Alay reconoció que se había trasladado al país aunque dijo que no se trataba de buscar apoyos para el independentismo, que eso era "una historia fantasiosa creada por Madrid", sino para reforzar los vínculos entre extranjeros y periodistas. La información, sin embargo, sostenía en base a informes de inteligencia que Alay se había reunido allí con funcionarios rusos, agentes de inteligencia y con el nieto de un espía de la KGB (antiguo servicio secreto de la Unión Soviética) con el objetivo de que el país ayudara a la separación de Cataluña del resto de España.

Además, esta investigación reveló que solo tres días después de que 'Tsunami Democràtic' bloqueara el aeropuerto de El Prat de Barcelona, Alay se reunió en un restaurante de la ciudad condal con Sergei Sumin (coronel del Servicio Federal de Protección de una agencia que supervisa la seguridad de Putin) y Artyom Lukoyanov (hijo adoptivo de un alto consejero de Putin), "profundamente involucrado en los esfuerzos rusos de apoyo a los separatistas de Ucrania oriental".

David Madí

Uno de los empresarios que forma parte del plantel de investigados y que confesó ante el juez que Rusia estaba interesada en apoyar al independentismo para que la futura república catalana aprobara una legislación favorable a las criptomonedas.

Aguirre remarca un documento que se intervino a Terradella en su casa en el que aparece manuscrito en los márgenes la palabra "Putin" con la palabra "financiación". Hay anotaciones como "Unificar bitcoin", "máquina", "Estado protector", "legislación adecuada al nuevo modelo económico", etc.

Madí, además de haber sido detenido en el 'caso Voloh', ha sido condenado a 14 meses de prisión por el 'caso Triacom', un entramado de facturas falsas para defraudar a Hacienda simuland o encargos de TV3.

Jordi Sardà Bonvehí

Un implicado en una presunta estafa con venta de gas de Ucrania y la persona que, según el sumario, puso en contacto a los emisarios rusos con Carles Puigdemont. En una conversación de mayo de 2018 con Terradellas se compromete a acudir a la sede de los espías de Moscú (FSB).

Alexander Dmitrenko

Un empresario ruso afincado en Cataluña que el juez relaciona con Alay porque fue la persona que, supuestamente, viajó a Rusia con él. El CNI investigó sus relaciones con el Kremlin.

Su actuación buscaba crear una estructura bancaria en el extranjero que permitiera inyectar fondos a los independentistas y, para ello, se reunió con Puigdemont y con otro financiero ruso (Yuri Emelin) en Ginebra, Suiza, en 2019 cuando el líder de Junts ya vivía allí.

En una entrevista que dio en 2022 a El País, señala que las informaciones que le ponen de espía son "un chiste que me halaga" y que él es simplemente "un empresario al que le apasiona la negociación, pero también la política". Dice que se dedica a la compraventa de yates, que tiene una consultoría, aunque reconoce que ha trabajado como asesor para la Fiscalía rusa.

Nikolay Sadovnikov

Es un antiguo diplomático ruso, supuestamente facilitador del acercamiento de Rusia con el procés. Según otra investigación periodística los servicios de inteligencia de Francia lo ubican como elemento clave en las operaciones de desestabilización orquestadas por el Kremlin.

El 26 de octubre de 2017, un día antes de la Declaración Unilateral de Independencia (DIU), se reunió con Elsa Artadi y con Víctor Terradellas en la vivienda oficial del presidente de la Generalitat, en la Casa dels Canonges de Barcelona.

La propia Artadi lo confesó ante el juez, si bien dijo que en ese encuentro hubo dos personas más "cuyos nombres dijo desconocer". Es ahí donde los emisarios rusos ofrecen ayuda económica y militar a Cataluña, según el sumario, ofrecieron 10.000 soldados rusos si era necesario a cambio de una legislación favorable para el negocio de las criptomonedas. Además, el magistrado Aguirre cita otra reunión en el Hotel Colón de Barcelona para hablar de bitcoins los días 20 y 24 de octubre de ese 2017.

Zakhar Kalashov, Vasili Kristoforov y Koba Shermazashivili

Son altos capos de la mafia rusa a los que el juez sitúa en las reuniones de Rusia a las que acudieron Alay y Boye. Para Aguirre no hay duda de que han existido "estrechas relaciones" entre los investigados con "individuos de nacionalidad rusa, alemana o italiana, algunos de ellos mientras ocupaban cargos diplomáticos o relaciones con los servicios secretos rusos".

Vasili Kristoforov

El juez dice: “Si los contactos entre el Kremlin existieron antes y después de octubre de 2017 puede extraerse la deducción de que había alguna persona común a Terradellas y Alay y por encima de ellos que permitiría tales contactos entre dirigentes de Convergencia Democrática de Catalunya ahora Junts per Cat y el Kremlin”.

Sin citarlo, el instructor apuntala artículos del Código Penal que quedan expresamente fuera del ámbito de actuación de la ley de amnistía porque suponen traición y deslealtad al Estado al haber contactado con miembros en activo de otros Gobiernos para participar en el movimiento secesionista. Esto supone un tiro directo al corazón de la ley que Junts y ERC pretenden emplear para borrar cualquier delito del procés durante la última década.

De nada vale tu opinión, si no se coincide con la de Pûigdemont.

Agredir y apalizar a ciudadanos adversos al terrorismo bueno.
Amnistiar a los responsables de organizar, financiar y poner en práctica los acciones del terrorismo bueno.
Permitir que el máximo responsable de estas acciones, fugado de la Justicia, retorne a España y pueda presentarse a las elecciones autonómicas y ser elegido presidente de la Generalidad.
Cancelar la investigación de la financiación del terrorismo bueno y proceder a la devolución del importe de las sanciones impuestas hasta el momento de la aprobación de la Ley.
Los terroristas buenos dejarán de ser considerados terroristas.

THE EASY CHOICE

Rafa Marquez is already at the club coaching the B team. He could even take over sooner rather than later if Barcelona decide that Xavi should not stay on until the summer. 

He is close to Deco and represented by Jorge Mendes who has huge influence now at the club. He said on Saturday night that if the chance came he would like to take it. The downside would be supporters' lack of enthusiasm for the appointment. 

He has so far not pulled up any trees with the second string. It's the easiest, but least impressive option.

TAKING FROM THE NEIGHBOURS

Just up the road from Barcelona, Girona are having an extraordinary season and so much of that is down to coach Michel. 

He has already guided his team to a victory over Barcelona this season and plays a brand of football they would love to see at the Olympic Stadium. 

The problem is that Michel is now a City Group man and might feel it best to take Girona into Europe for the first time in their history next season, knowing that if he does well he could get the Manchester City job after Pep Guardiola.

LAPORTA'S DREAM

He has always been a big fan of Jurgen Klopp and taking the Liverpool manager would delight Barcelona supporters. It's not quite the Barca style but no one would care if he brought the same brand of football his teams have produced at Anfield. 

The big problem would be persuading him to give up his plans for a sabbatical to take over at such a chaotic club. His wage demands would also be higher than Motta and Marquez. He looks out of reach.

THE FANCIED OUTSIDER

Julen Lopetegui is available and could be an option now or at the end of the season. He has worked with Mendes in the past and his record at his last Spanish club Sevilla was superb. 

He would sort out the shambolic defence and bring some dignified calm to a club whirling from one crisis to the next. Could become a very serious option if the club decide Xavi can't stay until June.

Francisco Garcia Pimienta was at Barcelona for over two decades as youth coach and has since thrived at Las Palmas. But it was current president Laporta who got rid of him and he's unlikely to U-turn. 

Jose Mourinho is free and would certainly serve up a fiery dose of shock treatment for Barcelona's sleepy stars but the supporters would never accept his appointment. 

Real Sociedad's Imanol Alguacil is highly-fancied but why would he leave his well-organised impressive club to take on such a huge task?

El juez dice en una nueva resolución que "no puede minimizarse esta acción ni el resultado grave que ocasionó, incompatible con el derecho a la vida" incardinado en el Convenio Europeo de Derechos Humanos

El juez de la Audiencia Nacional Manuel García Castellón no ve posible amnistiar algunos de los hechos más graves de la causa de 'Tsunami Democràtic', ni siquiera con la nueva enmienda pactada entre Junts y PSOE sobre el terrorismo. Este es el recado que ha dejado en la última resolución firmada sólo un día después del pacto en el Congreso: "No puede minizarse esta acción ni el resultado grave que ocasionó, incompatible con el derecho a la vida e integridad física".

En uno de los últimos trámites parlamentarios de la ley de amnistía en la cámara baja, los socialistas acordaron con los grupos independentistas y el resto de socios modificar el texto inicial que decía que se amnistiarían los delitos de terrorismo que no tuvieran sentencia firme, para introducir un nuevo concepto: quedarían bajo el perdón los actos terroristas que no fueran muy graves.

La redacción quedaba específicamente así: "Los actos tipificados como delito de terrorismo [...] siempre y cuando, de forma manifiesta y con intención directa, hayan causado violaciones graves de derechos humanos, en particular, las previstas en el artículo 2 y 3 del Convenio Europeo para la Protección de los Derechos Humanos y de las Libertades Fundamentales, en el derecho internacional humanitario".

Pero este nuevo texto (más acorde a los estándares constitucionales y europeos, según fuentes jurídicas) dejaba un mayor margen de interpretación a los jueces, tal y como contó El Independiente.

El magistrado ha rubricado un nuevo auto con fecha de este 24 de enero para confirmar la personación en la causa de dos policías heridos graves en los incidentes de Barcelona en octubre de 2019, tras la sentencia del procés. García Castellón dice que la gravedad de esta acción, la repercusión pública que tuvo y el notorio interés mediático que motivó la hospitalización de los agentes lesionados, llevó incluso a que el presidente del Gobierno en funciones en aquel momento, acompañado del ministro del Interior, acudiera a visitarles al hospital donde permanecían ingresados.

Y sobre esto sustenta que los hechos podrían estar incardinados en el artículo 2 del Convenio Europeo de Derechos Humanos, precisamente el que cita explícitamente la ley de amnistía. En este punto se habla sobre el derecho a la vida. Esto complica la pretensión de los líderes independentistas investigados en este causa de ser perdonados una vez entre en vigor la norma.

Cabe recordar que el Tribunal Supremo tendrá que pronunciarse sobre la admisión de la exposición razonada que envió el juez García Castellón por considerar que debía ser ese órgano el competente para investigar a los aforados como el expresidente Carles Puigdemont.

Jurgen Klopp has announced he will leave Liverpool at the end of the season - bringing down the curtain on nine years in English football. 

The German boss revealed the news on Friday morning in an interview with the club's website, saying he is 'running out of energy' after winning the Premier League, Champions League, the FA Cup and Carabao Cup

'I will leave the club at the end of the season,' he said. 'I can understand that it's a shock for a lot of people in this moment, when you hear it for the first time, but obviously I can explain it – or at least try to explain it.

'I love absolutely everything about this club, I love everything about the city, I love everything about our supporters, I love the team, I love the staff. I love everything. But that I still take this decision shows you that I am convinced it is the one I have to take.

'It is that I am, how can I say it, running out of energy. I have no problem now, obviously, I knew it already for longer that I will have to announce it at one point, but I am absolutely fine now. I know that I cannot do the job again and again and again and again.

The president of Liverpool owner Fenway Sports Group expressed their gratitude towards Klopp for his achievements at the club and said plans were already underway to ensure the Reds succeed when the German has departed.

Klopp took over Liverpool in 2015 from Brendan Rodgers, tasked with overhauling a struggling side that had come close to winning trophies, but had often fallen short. 

He had to be patient for his first piece of silverware - which came in 2019 as his side beat Tottenham in the Champions League final.

One year later, he led his team to their first Premier League title win in 30 years as they romped to victory with 99 points to see off their bitter rivals Man City. 

The Club World Cup and UEFA Super cup followed and in the 2021-22 season his side won the double of the FA Cup and Carabao Cup.

Klopp became renowned for his passionate displays on the touchline, bust-ups with rival managers, snappy retorts at journalists and often hilarious moments and displays of his lighter side in press conferences. 

He was also a vocal critic of the Premier League's notoriously jam-packed fixture schedule - and would never hold back if he felt his team had been on the wrong end of a bad refereeing or VAR call.

I can understand that it’s a shock for a lot of people in this moment, when you hear it for the first time, but obviously I can explain it – or at least try to explain it.

I love absolutely everything about this club, I love everything about the city, I love everything about our supporters, I love the team, I love the staff. I love everything. But that I still take this decision shows you that I am convinced it is the one I have to take.

It is that I am, how can I say it, running out of energy. I have no problem now, obviously, I knew it already for longer that I will have to announce it at one point, but I am absolutely fine now. I know that I cannot do the job again and again and again and again.

After the years we had together and after all the time we spent together and after all the things we went through together, the respect grew for you, the love grew for you and the least I owe you is the truth – and that is the truth.

I told the club already in November. I have to explain a little bit that maybe the job I do people see from the outside, I’m on the touchline and in training sessions and stuff like this, but the majority of all the things happen around these kind of things. That means a season starts and you plan pretty much the next season already.

When we sat there together talking about potential signings, the next summer camp and can we go wherever, the thought came up, ‘I am not sure I am here then anymore’ and I was surprised myself by that. I obviously start thinking about it.

It didn’t start [then], but of course last season was kind of a super-difficult season and there were moments when at other clubs probably the decision would have been, ‘Come on, thank you very much for everything but probably we should split here, or end it here.’ That didn’t happen here, obviously.

For me it was super, super, super-important that I can help to bring this team back onto the rails. It was all I was thinking about. 

When I realised pretty early that happened, it’s a really good team with massive potential and a super age group, super characters and all that, then I could start thinking about myself again and that was the outcome. It is not what I want to [do], it is just what I think is 100 per cent right.

This comes after Kim was blasted by fans after revealing she has become an ambassador for Balenciaga, one year after the brand faced controversy for an advert featuring children and BDSM items.

The star announced her partnership with the label, helmed by creative director Demna Gvasalia, on Monday.

The mother-of-four previously refused to cut ties with the fashion house but said she was 'shaken and disgusted' by the images which sparked a backlash against the brand.
