In a move that viewers claimed was reminiscent of Kanye West's infamous 2009 MTV VMAs speech, Jay-Z launched into an impassioned rant as he pointed out the ludicrousness that Beyonce is the Grammy's most-awarded artist with 32 honours, but none for the top prize. 

The Brooklyn-born rapper made his speech at Sunday night's Grammys when he was honoured with the Dr. Dre Global Impact Award for his contribution to the music industry.

With his 12-year-old daughter Blue Ivy standing on stage beside him, and Beyonce looking on from their table in the audience, dressed in just-off-the-catwalk Louis Vuitton by Pharrell Williams, Jay-Z spoke about the importance of dreams, drive and ambition before referencing his wife of 14 years. 

'I don't want to embarrass this young lady, but she has more Grammys than everyone and never won Album of the Year,' Jay-Z said.

Taking aim at other nominees, Jay-Z continued: 'Some of you are gonna go home tonight and feel like you've been robbed. Some of you may get robbed. Some of you don't belong in the category. When I get nervous, I tell the truth.' 

Viewers were quick to speculate if he was taking aim at Taylor with his remarks, who has received 52 Grammy nominations and won 14, four of which have been Album Of The Year.

Conversely, Beyonce has been nominated for 88 competitive Grammy Awards, six times for Album of the Year.

Jay-Z has also been nominated for 88 competitive Grammy Awards, winning 24 of them. Like his wife, six of his nominations have been for Album of the Year.

Taking to X, formerly Twitter, during Jay-Z's speech, viewers compared his rant to Kanye's while one fan noted that men have tried to pit Beyonce and Taylor against one another, noting:' So Jay-Z and Kanye West are best mates again? 

'At least she was able to finish this time. It’s funny, Taylor Swift and Beyoncé literally show up for each other. It is toxic masculinity that perpetuates the wicked female narrative. #GRAMMYs.'

When Taylor, who was 19 at the time, was giving an acceptance speech for Best Female Video, Kanye stormed the stage and declared that Beyonce's music video deserved to win over Taylor's.

During the live broadcast, Kanye grabbed the mic from Taylor's hand, to tell the audience that Beyoncé's Single Ladies video deserved the award, instead of Taylor's You Belong With Me.

'Yo, Taylor, I'm really happy for you, I'mma let you finish,' Kanye said as he took to the stage. 'But Beyoncé had one of the best videos of all time! One of the best videos of all time!'

Later in the evening, when Beyonce picked up an award of her own, she famously called Taylor to the stage in a display of unity and invited her to finish the acceptance speech that Kanye had so rudely interrupted. 

Last year, the pair continued to show each other support as they attended the premieres for each other's concert tour films. 

Yet the narrative that they are feuding has still prevailed, despite Taylor insisting that she is 'actively rejecting' it.

Taylor told TIME magazine last year: '[Beyonce] is the most precious gem of a person— warm and open and funny. And she’s such a great disrupter of music-industry norms.

'She taught every artist how to flip the table and challenge archaic business practices… There were so many stadium tours this summer, but the only ones that were compared were me and Beyoncé. 

'Clearly it’s very lucrative for the media and stan culture to pit two women against each other - even when those two artists in question refuse to participate in that discussion.

Elsewhere in Jay-Z's Grammys speech he said the awards were subjective - but nice to win.At the start of his speech, he joked that his Grammy Awards used to be used as sippy cups for Blue Ivy - but now 'she has her own Grammys,' he said.

The 12-year-old won her first Grammy aged nun, with a writing credit for Brown Skin Girl, which won in 2021 for her mother.

Jay-Z continued: 'How far we've come from Will Smith and Jazzy Jeff winning their first Grammy in '89 and boycotting because it wasn't televised. 

'And then they went to the hotel and watched the Grammys. I didn't even understand. It wasn't a great boycott.'

He said that he then did a similar thing. 

'But then '98, I took a page out of their book. I was nominated for Best Rap Album, and DMX had dropped two albums that year. They both were number one — shout out to DMX — and he wasn't nominated at all. 

'So I boycotted and I watched the Grammys. 

'I'm just saying, we want y'all to get it right. We love y'all. We love y'all. We love y'all. We want y'all to get it right. At least get it close to right.'

He then launched into his critique of the awards, and his condemnation of the failure to recognize his wife. 

'Obviously it's subjective because it's music and it's opinion-based,' he said. 'So even by your own metrics, that doesn't work.

'Some of you are gonna go home tonight and feel like you've been robbed. Some of you may get robbed. Some of you don't belong in the category. When I get nervous, I tell the truth.'

He added: 'But outside of that, we got to keep showing up — and forget the greatness for a second, just in life. 

'As my daughter sits and stares at me nervous as I am, you got to keep showing up. Just keep showing up to get the Grammys. 

'You got to keep showing up until they give you all those accolades you feel you deserve. Until they call you champion, until they call you a genius, until they call you the greatest of all time.'

This year's Dr. Dre Global Impact Award was shared by Jay-Z, Lenny Kravitz and Mariah Carey.

The award, created in 2022, has previously been presented to John Legend, Dr. Dre, Missy Elliott, Lil Wayne, and music executive Sylvia Rhone.

Puigdemont reta al Gobierno: "No hay Ley que prohíba amnistiar el terrorismo"

Distintos expertos de Derecho Penal discrepan sobre si añadir este delito en la ley del perdón podría hacerla caer en Europa, como sostiene el PSOE


Contra todo pronóstico la ley de amnistía no ha sido aprobada esta semana por la falta de votos del partido que, precisamente, la había impulsado. Junts logró el martes que el texto no superara el trámite del pleno en el Congreso de los Diputados y ahora, aunque aún está por decidir si hay que volver a la casilla de salida, lo que está claro es que no pretenden ceder: o la norma contempla el terrorismo o no habrá perdón para el procés.

El escollo no es menor. Supone incluir en el texto delitos graves como lo es el terrorismo o el que se refiere a la alta traición al Estado y sobre ello hay dos corrientes bien distintas. De un lado, está la que sigue el PSOE, que asegura que añadir estos ilícitos supondrá que Europa tire la ley en su conjunto. Del otro lado, está el partido de Carles Puigdemont que perjura que no hay ni jurisprudencia, ni texto europeo que prohíba expresamente amnistiar el terrorismo.

"El único argumento es que Europa lo va a tumbar. ¿Alguien ha dado algún argumento de alguna sentencia, algún artículo, alguna norma? No. Porque no existe", expresa a El Independiente una fuente cercana a Junts.El independentismo apoya su tesis en la falta de precedentes y en que España ha tenido otras amnistías como la de 1977 que condonó todo tipo de delitos (incluida la tortura y el terrorismo, por ejemplo) y que, si bien fue previa a la Constitución, posteriormente el Tribunal Supremo la avaló. Se basa para eso en una sentencia de febrero de 2012 en el marco de un procedimiento en que analizaron la conducta del exjuez Baltasar Garzón sobre la investigación de crímenes franquistas.

"Precisamente, porque la 'Transición' fue una voluntad del pueblo español, articulada en una ley es por lo que ningún juez o tribunal, en modo alguno, puede cuestionar la legitimidad de tal proceso. Se trata de una ley vigente cuya eventual derogación correspondería, en exclusiva, al Parlamento", dijo el alto tribunal. Para las fuentes de ese sector, esta sentencia es clara: "El Supremo dice que la ley está en vigor, que nunca ha sido derogada y que es constitucional, es decir, forma parte del ordenamiento jurídico". Y en esa estrategia construyen que una nueva amnistía con delitos de terrorismo dentro no supondría ningún problema.

Defienden, por ejemplo, que la última gran amnistía a nivel internacional la realizó Filipinas en 2021 con delitos de terrorismo, rebelión y sedición. "¿Cuál fue la consecuencia? Que las personas que fueron amnistiadas fueron retiradas de la lista de EEUU de personas que no podían entrar al país por delitos de terrorismo. Esa fue la consecuencia tan grave de amnistiar", reflejan dichas fuentes.

Junts se ampara en que el Tribunal de Justicia de la Unión Europeo (TJUE) no va a poder echar para atrás la ley completa porque España sigue persiguiendo los delitos de terrorismo y la Directiva Europea de 2017 que habla sobre ello no menciona nada de que no se puedan perdonar llegado el caso. Justifican, asimismo, que el riesgo de que en Luxemburgo vean la ley con malos ojos está cubierto porque la medida no permite que se amnistíen los delitos que tengan que ver con la malversación de fondos comunitarios.

Discrepancias entre los expertos

Esta visión no es compartida por los distintos expertos consultados. Partiendo de la premisa de que algunos creen que la amnistía directamente es inconstitucional y no cabe en la Carta Magna, miembros de este grupo explican que introducir o no el terrorismo no cambia el escenario. "Hablar de terrorismo relacionado con las manifestaciones del aeropuerto desde el punto de vista jurídico no se sostiene. Entonces ir modificando al hilo de los autos que dicta el juez Manuel García Castellón es una locura", repone una fuente jurídica que no ha querido ser citada.

"Suponiendo que la amnistía sea constitucional yo entiendo que se puede amnistiar todo delito que la ley quiera meter dentro", refleja, explicando que los remilgos del PSOE tienen más que ver con una cuestión política que jurídica. "Ni siquiera chocaría con las Directivas Europeas porque también hay directivas que prohíben otros delitos que se indultan todos los días", dice.

Pero no todos coinciden. "La Directiva de lucha contra el terrorismo yo creo que complicaría la viabilidad de la amnistía en el TJUE. Si admitiéramos que el que dicta la norma puede admitir excepciones, entonces la tipificación quedaría en nada", defiende el catedrático de Derecho Penal de la Universidad de Barcelona Xavier Arbós. Para él la amnistía es inconstitucional de base, pero "si encima lo que haces es proponer una ley de amnistía que le hace un traje a medida no a todos los potencialemente amnistiables, sino a algunos, entonces lo estás poniendo peor", explica.

"No existe una previsión específica para amnistiar el terrorismo, pero claro todo lo que la UE ha ido sacando en materia de normas de armonización choca con que se amnistíe el terrorismo en general", coincide el catedrático de Derecho Penal de la Universidad Autónoma de Madrid Manuel Cancio. En su opinión, es discutible establecer distinciones entre un terrorismo u otro pero lo que tiene claro es que 'Tsunami Democràtic' no lo fue. "El terrorismo siempre implica el uso de violencia contra las personas. No parece muy compatible con la posición de la Unión Europea [que se amnistíen]. Lo que ocurre es que en España en 2019 no hubo terrorismo", esgrime.

En una posición intermedia se ubica Miguel Bustos, profesor de Derecho Penal de la Universidad de La Rioja. "Si la pregunta es si es menos constitucional amnistiar el terrorismo yo diría que a priori no. La norma podría ser constitucional si vulnera o no la igualdad de los españoles", aclara. El recorrido en el Tribunal Constitucional depende de otras líneas, pero el problema sí lo ve a ojos de los Veintisiete. "La UE tiene unas líneas rojas muy claras y una de ellas es el terrorismo. Aunque la UE no tiene competencia penal directa yo creo que aquí está en quid de la cuestión y esto de los distintos tipos de terrorismo no creo que tenga mucho recorrido si llega allí", sostiene.

Lo cierto es que ninguno de los consultados cita jurisprudencia o normas específicas de la Unión Europea que contengan esta prohibición, si bien lo que está claro es que no hay precedentes de una amnistía de estas características en el marco de la Unión tal y como se conoce ahora. Por eso es difícil acertar en qué lectura exacta hará el TJUE sobre el perdón cuando llegue a su mesa.

EP El miércoles se reunieron en Bruselas el ministro de Justicia, Félix Bolaños, y el vicesecretario de Acción Institucional del PP, Esteban González Pons, con el comisario europeo Didier Reynders para hablar... de la renovación del Consejo General del Poder Judicial (CGPJ). La fotografía distribuida por las agencias es un fiel reflejo de lo que sucedió en esa extraña cita. Reynders en el centro, flanqueado por Bolaños y González Pons. Al comisario europeo parece que le va a atropellar un automóvil, tiene a su espalda una gran fotografía de una de las principales avenidas de la capital belga. La puerta permanece abierta, lo que da idea de una cierta falta de intimidad. La principal conclusión del encuentro es que habrá una nueva reunión. Esta vez el 12 de febrero. Se supone que también en Bruselas. Las valoraciones de los asistentes, "cordial", "positiva", aunque vacías, al menos denotan que ninguno de los dos protagonistas ha acudido con la idea de dinamitar la negociación. Al menos en estos primeros tanteos. 
 

 La conversación se desarrolló en inglés, dado que Reynders no sabe español. Aunque hubo momentos en los que Bolaños y González Pons se intercambiaron frases en castellano. De hecho, fue lo más sustancioso del encuentro. Me imagino a Reynders mirándoles a los dos como si estuviera en un partido de tenis. El máximo órgano del Poder Judicial español lleva más de 5 años con el mandato vencido. El retraso en la renovación está provocando un colapso en el Tribunal Supremo, la Audiencia Nacional y en los Tribunales Superiores de Justicia. La situación es especialmente grave en el caso de la Sala Tercera del Supremo. Esta situación crítica es la que ha forzado este nuevo acercamiento. Hasta ahora se han producido dos intentos de acuerdo (el último en octubre de 2022) que terminaron en fracaso. Pero la cuerda está a punto de romperse. Los propios jueces han reclamado abiertamente que se ponga fin a este bloqueo. El anterior presidente del CGPJ, Carlos Lesmes, dimitió por esa causa. Su sustituto, Vicente Guilarte, ha insinuado que hará lo mismo si no hay acuerdo. Habrá seguramente acuerdo para renovar el CGPJ después de las elecciones gallegas. Pero todavía no se sabe qué demonios pinta en esta negociación el comisario de Justicia europeo En este asunto, los dos partidos han priorizado criterios tácticos. Y sigue siendo así. Por eso no es probable que haya fumata blanca hasta después de las elecciones en Galicia (18 de febrero). Tanto PP como PSOE piensan que una foto de Feijóo y Sánchez estrechándose las manos les perjudica. Tampoco ayuda el proceso negociador de la ley de Amnistía, en el que el Gobierno tendrá que volver a ceder un poco más para que Junts dé su visto bueno. Pero, a diferencia de otras ocasiones, ahora el bloqueo no se puede prolongar. 
 
Por eso creo que habrá acuerdo. De hecho, en la anterior intentona todo estaba ya cerrado hasta que Feijóo se enteró por El País de que Sánchez quería reformar el delito de sedición para lograr el apoyo de ERC. Los protagonistas son los mismos: Bolaños y González Pons. Los criterios no han cambiado, aunque el PP insiste en que no habrá renovación sin acuerdo sobre el sistema de elección, para que sean los jueces y sólo los jueces los que elijan a los miembros del CGPJ. A mí no me cabe duda de que habrá renovación y promesa de cambio. González Pons dice que en esta negociación hay que ir partido a partido, como el Atlético del Cholo, aunque él es del Valencia. Esa prudencia es otro dato que me hace pensar que habrá acuerdo. Feijóo advierte sobre el CGPJ: "Renovación y ley, ya nos han engañado una vez" Feijóo advierte sobre el CGPJ: "Renovación y ley, ya nos han engañado una vez" Pero, volvamos a la fotografía de Bruselas. Quien sobra ahí es Reynders. Nadie entiende por qué Bolaños y González Pons tienen que ir a Bruselas cuando pueden reunirse en Madrid. ¿Pero qué pinta el comisario europeo en un asunto tan domestico como la renovación del Poder Judicial español? La idea de meter al comisario fue de Núñez Feijóo. Se la trasladó al presidente del Gobierno en su reunión del pasado 22 de diciembre. Yo me quedé con la boca abierta porque el PP, con toda la razón, había criticado la propuesta de Puigdemont de recurrir a un mediador extranjero para negociar no se sabe qué cosas sobre el proceso político en Cataluña. Afortunadamente, no se ha vuelto a saber nada de aquel especialista en conflictos. Para pactar ya se bastan Bolaños, Cerdán, Zapatero, Puigdemont, Turull y Nogueras. El Gobierno y el PP deberían cuidar las formas. Dejar orilladas las tácticas y pensar más en la Justicia y en los ciudadanos. Porque con todo el follón de la amnistía y el ataque despiadado de los socios del Gobierno a los jueces, a los que acusan de "prevaricadores", la que está saliendo peor parada es la imagen de la Justicia. El reparto descarado de cargos en función de afinidades políticas da pábulo a la acusación de lawfare que hacen desde Sumar hasta Junts, pasando por todos los demás. Así que, cuanto antes se cierre la renovación, cuanto mejores sean los nuevos miembros del CGPJ y menos se hable de jueces que actúan por motivaciones políticas (eso lo dice nada menos que una vicepresidenta del Gobierno), será mejor para la Justicia. Sería bueno, sobre todo, para que los ciudadanos sigan creyendo en el Estado de Derecho.
