El Constitucional dice ""NO"" el desafío independentista catalán.


El pleno extraordinario admite a trámite los recursos presentados por el Gobierno de Rajoy contra el referendo del 9-N y la ley que lo ampara, lo que paraliza la iniciativa de Artur Mas. 


El guión se va cumpliendo. El pleno extraordinario del Tribunal Constituciona ha admitido a trámite los dos recursos presentados por el Gobierno contra el referendo soberanista del 9-N y la ley que lo ampara. Tal y como prevé la ley, la decisión del pleno, reunido de urgencia esta tarde, implica la paralización del desafío soberanista catalán durante al menos cinco meses.

El artículo 161.2 de la Constitución establece que la impugnación del Gobierno producirá la suspensión de la disposición o resolución autonómica recurrida y que el Constitucional puede ratificar o levantar esa suspensión en un plazo de cinco meses. Una vez que el tribunal admite las demandas del Gobierno, Cataluña dispondrá de quince días para personarse y formular alegaciones en quince días.

Los principales argumentos esgrimidos por el Gobierno de Rajoy para pedir la paralización de la consulta es que una comunidad autónoma no tiene competencias para realizar un referéndum y que la consulta «atenta contra la atribución de la soberanía nacional, que corresponde al pueblo español» y contra la «indisoluble unidad de la Nación española».

The downing of the Russian Su-24 by the Turkish Air Force and Washington's tacit approval of Ankara's actions following the treacherous attack was certainly a reflection of their anxiety over the Russo-Syrian advance, according to Salman Rafi Sheikh, a research-analyst of International Relations and for Pakistan's foreign and domestic affairs.

However, the "backstabbing" provocation did not work; it did not halt Russia's air campaign, but rather prompted its intensification. The US strategy to force a Russian military 'exodus' from Syria has failed and Washington is obviously not happy with it.

"In fact, the US' priority is the prospect of an Anglo-American caucus emerging within the US-led coalition as its 'steel frame' so that things remain under control. Russia's induction, on the other hand, might altogether change the alchemy of the coalition, make it unwieldy and shut the door on any future prospect for NATO assuming the role of a peacemaker or peacekeeper in the Middle East," Sheikh elaborates.
According to the analyst, the White House would prefer it if Russia was excluded from the future political settlement in Syria thus untying Washington's hands. However, it seems that the opposite might happen in near future.
"With Russia all set to intensify its campaign with or without any coalition, the US and its allies seem to have unwittingly fallen a poor prey to what can better be called their folly of judgment," Sheikh concludes.

And while the more discerning observer can present a list of prominent names as evidence that the club always sells at the right price, those insisting privately that Kane is going nowhere also speak with rather more confidence and authority than they might have done in the past.

It is a measure, perhaps, not only of what they perceive to be Kane's enduring commitment to the club he joined as an 11-year-old but of where Tottenham think they are heading at the beginning of 2016.

But supporters still grieving the loss of players like Gareth Bale and Luka Modric, not to mention Michael Carrick and Dimitar Berbatov, remained nervous enough to seek certain assurances from Levy. They wanted him to tell them that individuals of the quality of Kane and Dele Alli would not be sold as well.
'If the football side say it affects equilibrium of the squad if we have a player who doesn't want to be here, then we look at it,' Levy said. 'In the end, it's up to Mauricio to decide who he does or doesn't want.'
Levy, of course, has something of a reputation for selling players anyway but it is a reputation he is said to consider rather unfair.

But they would also argue that Levy agreed not to sell Modric to Chelsea when Harry Redknapp requested that the Croat remain at the club for one more year. Only then was he allowed to move to Real Madrid.
Those same allies insist the sale of Bale to Madrid occurred only because Andre Villas-Boas concluded that it was best that he go, apparently during a pre-season tour to the Far East when it became clear to the then Spurs manager that the distraction of a big-money transfer was beginning to impact on that all-important equilibrium.
'The first person who wants to help me improve the squad is Daniel,' Pochettino told the same set of fans at that recent forum, and if that really is the case then maybe there has been a shift in the overall mindset at White Hart Lane.
Maybe they do now consider themselves serious contenders rather than a second-tier club that expects to lose its best players to the continental elite.

As they prepare for Sunday's visit to Everton, there does seem to be a degree of excitement around the club and much of it emanates from those stadium plans and a 43-year-old manager who commands so much respect from his colleagues.

Pochettino values the opinion of the France goalkeeper to such an extent that they meet regularly in the manager's office, seemingly developing the kind of understanding Ferguson once enjoyed with Roy Keane.

But under his guidance a coaching staff that once included Chris Ramsey and Alex Inglethorpe — now the academy director at Liverpool — has provided the current Spurs dressing room with a core of homegrown players further enhanced by what insiders say is a 'lack of egos' thanks to the departure of certain individuals.
'The most important thing is the balance of the team and our power is our changing room,' said Pochettino on Thursday.
He believes in signing 'not just good players but good people', which would suggest he might well agree with Redknapp's view that West Bromwich Albion striker Saido Berahino is not a risk worth taking. Pochettino prefers players like Kane, and not just because he ends the calendar year having scored 27 goals. He is committed to the club and at 22 is already considered mature enough to be the vice- captain. Indeed, he was singled out as a future Spurs captain by officials some years ago.

'With the balance we have, we need to be careful who we bring in,' Pochettino said recently and there is no doubt Spurs have struck an impressive balance between defensive solidity and attacking flair, as well as a doggedness they most definitely displayed in Monday's late 2-1 victory at Watford.
Of course, to sustain success on the field a club needs to be built on solid financial foundations and Levy is said to be confident that the new stadium will provide that in the long term.
The new ground is designed to maximise potential revenue with a retractable pitch that covers an artificial surface suitable for NFL games and live entertainment events, and the club hope Tottenham — complete with new housing, a hotel and a cinema — will become London's 'next destination'.

Un debate plural, con académicos con diferentes puntos de vista y el objetivo de dar respuesta a dos preguntas. ¿Hacia dónde se dirige la articulación territorial del Estado y hacia dónde tendría que ir?
El catedrático Antoni Zabalza, de la Universidad de Valencia, ex secretario de Estado de Hacienda, recordó ayer que la deuda catalana está en 61.876 millones, el 31 % de su PIB autonómico. En el supuesto de que consolidase una independencia y asumiese además la parte proporcional que le correspondería de la del Estado, la cifra se elevaría hasta 220.000 millones. Es decir, se multiplicaría casi por cuatro. Un cálculo manejando el escenario más desfavorable para Cataluña pero que, en el mejor de los casos, colocaría la cifra por encima de 180.000 millones. Por contra, los ingresos con la independencia pasarían de 21.000 a 55.000 millones. El segundo gran coste de transición vendría dado por el impacto en el comercio y por la salida de la UE.

Pero parte del debate estuvo centrado en las balanzas fiscales. Mientras Zabalza sostuvo que los datos disponibles impiden cualquier defensa de la teoría de un expolio fiscal a Cataluña, Maite Vilalta, profesora de Economía Pública de la Universidad de Barcelona, y Xaquín Fernández Leiceaga, profesor de Economía en la USC, pusieron el acento en algunos desequilibrios del actual modelo, como los mecanismos de nivelación que permiten a regiones más pobres acabar con una financiación per cápita desproporcionadamente alta. Según los cálculos de Vilalta, un modelo similar al cupo vasco reportaría a Cataluña unos ingresos superiores en 10.000 millones de euros a los de ahora. Pero esto supondría, según otros expertos, que Cataluña dejaría de aportar 8.400 millones para el resto de autonomías, con el consiguiente perjuicio.

En la jornada también se colocaron otros interrogantes. ¿Puede Cataluña calcular el beneficio de su independencia partiendo de que su PIB y su población permanecerían invariables? ¿No habría fuga de capitales y empresas? Estos fueron interrogantes planteados por el profesor Pedro Puy, portavoz del PP en el Parlamento gallego. Xavier Ferreira, profesor de la USC, planteó el debate más allá de los números. Y puso como ejemplo el caso vasco, donde con un sistema ventajoso como el cupo, sigue prevaleciendo el sentimiento nacionalista. Xavier Vence, catedrático y portavoz del BNG, planteó cambiar el modelo de un Estado que drena recursos hacia el agujero negro de Madrid.

Soraya Sáenz de Santamaría, ha asegurado que el Gobierno actuar «con agilidad y celeridad» una vez que se publique la ley de consultas catalana y Artur Mas, presidente de la Generalitat, firme el decreto de convocatoria del referéndum independentista para el 9 de noviembre, firma anunciada para el próximo sábado.

En declaraciones en los pasillos del Congreso, la vicepresidenta ha instado a Mas a no aprobar ese decreto apoyado en una ley «que sabe que es inconstitucional, porque no es posible un referéndum de autodeterminación en España». «Los españoles decidieron que lo que era España. Lo decidíamos entre todos y eso es lo que tenemos que defender», ha añadido. Sáenz de Santamaría no ha querido precisar cuándo dará el Gobierno sus pasos para recurrir ante el Tribunal Constitucional tanto la ley como la convocatoria de la consulta. Sólo ha insistido en que una vez publicada la norma autonómica, se pondrán en marcha los «mecanismos del Estado» previstos: aprobación de un dictamen por el Consejo de Estado, reunión del Consejo de Ministros e interposición de recurso.

Rajoy, se encuentra en China de viaje oficial y estará de vuelta en España el sábado. Santamaría no ha querido precisar si ella, como presidenta en funciones, convocará un Consejo de Ministros extraordinario el sábado, si éste se celebrará el domingo, ya con Rajoy en Madrid, o si se esperará al lunes. El registro del Tribunal Constitucional, ante el que se presentan los recursos, permanece cerrado los fines de semana y abrirá a las nueve de la mañana del lunes. «El presidente del Gobierno ha dejado todo previsto, vuelve el sábado. Allá el presidente de la Generalitat cuando quiera poner en marcha las cosas. El Gobierno le contestará con los mecanismos de la Constitución y de las leyes», ha sido su respuesta.

Soraya Sáenz de Santamaría ha insistido en que el Ejecutivo quiere ser rápido. «Cuando el señor Artur Mas decida publicar ese decreto, ya hemos visto que el tiempo para él es muy flexible, para nosotros no, en cuanto lo publique, la maquinaria del Estado se pone en marcha en defensa de la democracia de los españoles, de las reglas del juego», ha dicho.

Justo cuando se publique la ley catalana de consultas, el ministro de Hacienda y Administraciones Públicas, Cristóbal Montoro, será el encargado de tramitar ante el Consejo de Estado la solicitud de dictamen. Este órgano consultivo deberá reunirse para aprobar el dictamen, lo que puede ocurrir si es necesario en cualquier momento del fin de semana. El documento se encuentra redactado y pendiente únicamente de aprobación, dada la jurisprudencia, los antecedentes y el conocimiento que se tiene de la ley de consultas por su tramitación parlamentaria.

Entre otras cosas, se han tenido en cuenta los votos particulares de los miembros del Consejo de Garantías Estatutarias catalán que rechazaron el proyecto de ley de consultas. Cuando el Parlamento envió a este órgano el texto legal para pedirle opinión, cuatro de sus nueve miembros votaron en contra de la norma por considerarla contraria a la Constitución y también al Estatuto de Autonomía catalán. Una vez recibido este dictamen, el presidente del Gobierno reunirá al Consejo de Ministros y ordenará la presentación del recurso, acompañada de la solicitud de suspensión inmediata de la ley. Debe ser el Pleno del Tribunal Constitucional el que lo admita a trámite y este órgano se reunirá si no tiene convocada una sesión ordinaria.


Con que solo se admita a trámite por el Constitucional quedará en suspenso  la ley catalana con carácter retroactivo, es decir, que no entrará en vigor y no serán por tanto válidos los actos derivados de su aplicación. El Gobierno ha mantenido desde el principio que recurrirá tanto la ley de consultas como la convocatoria del referéndum, lo que puede hacer de manera paralela, conjunta e indistintamente.

El abogado Jaume Alonso-Cuevillas, que coordina la defensa del expresidente de la Generalitat Carles Puigdemont, cree que existen "elementos muy sólidos" para pensar que la extradición puede ser denegada".

En una entrevista de Rac1 recogida por Europa Press, ha considerado que la detención el miércoles del hombre que acompañaba en Alemania al líder de JxCat fue "un show", y ha negado que haya cometido ningún delito.



El abogado ha defendido que Josep Lluís Alay, que fue puesto en libertad posteriormente, es un historiador experto en relaciones internacionales que "hacía un poco de asistente" a Puigdemont, lo que no es ilegal, y ha relatado que la Policía Nacional le había puesto un localizador en el coche.

"Formalmente no nos han dicho de qué se lo acusa. Tampoco nos han dicho si tiene que pasar a disposición judicial", ha criticado el letrado, que ha rechazado que se pueda tratar de un presunto caso de encubrimiento al haberse producido fuera de España y dado que Puigdemont se trasladaba a Bélgica para acudir ante el juez y dar así cumplimiento a la euroorden emitida por el Tribunal Supremo, ha asegurado.



Así, ha enmarcado el arresto en "una campaña del miedo, de poner nervioso al entorno del presidente Puigdemont", y ha reprochado a los servicios de inteligencia que esperaran a que el expresidente llegara a Alemania para efectuar la detención.



Sobre la inclusión del delito de corrupción en la euroorden emitida por el juez Pablo Llarena --que, de probarse, comportaría la extradición inmediata--, ha asegurado que "desacredita" la petición del Supremo.

El anuncio, que ocupa una página de los periódicos "Ara", "El Periódico de Catalunya", "El Punt-Avui", "La Vanguardia" y "El País", llama a los catalanes a acudir el 9 de noviembre a las urnas y añade el enunciado de la pregunta de la consulta soberanista.
"Recuerda que el 9 de noviembre tienes una cita", reza la publicidad institucional, que incluye diez fotografías con la fecha de la consulta de independencia, 9N, escrita sobre distintos soportes, desde la palma de una mano, un "post-it", una pizarra, un teléfono móvil o un imán de nevera.
Bajo las fotografías, el anuncio incluye las dos preguntas de la consulta, junto al lema "Tú decides. Consulta popular no refrendaria sobre el futuro político de Cataluña" y un logotipo con una mano introduciéndose en una urna.
De hecho, la Generalitat ya emprendió ayer la campaña institucional de la consulta del 9 de noviembre en la web 9nconsulta2014.cat, que llama a acudir a las urnas e informa sobre quién puede votar y cómo y dónde puede depositar la papeleta.
La campaña incluye además un anuncio televisivo en el que una voz en off dice: "El 9 de noviembre todos estamos convocados a la consulta popular no refrendaria sobre el futuro político de Cataluña con la siguiente pregunta: ¿Quieren que Cataluña se convierta en un Estado? y, en caso de respuesta afirmativa, ¿Quieren que ese Estado sea independiente? Recuerda, el 9 de noviembre tienes una cita; tú decides".
Desde la web también se puede descargar en formato PDF la papeleta de la consulta del 9N. El portal incluye el texto del decreto de la convocatoria y de la ley de consultas, así como un apartado que explica el "sistema de garantías" para "garantizar la fiabilidad, la transparencia, la neutralidad y la objetividad del proceso de consulta".

Convocada ayer la consulta, la vicepresidenta de la Generalitat, Joana Ortega, presenta hoy en rueda de prensa los detalles del dispositivo logístico que tiene preparado el Gobierno catalán para la votación.

Montoro asegura que las pensiones subirán(0.25%) en 2015

El ministro de Hacienda, Cristóbal Montoro, ha asegurado este viernes que las pensiones subirán en 2015 "al menos" el 0,25%, el suelo mínimo recogido en la última reforma de pensiones. 

Montoro, que ha sido preguntado en varias ocasiones por si la subida de las pensiones se quedará en el 0,25%, ha señalado que las pensiones se incrementarán en "al menos" esa cifra. 

El ministro ha recordado que la economía española no tiene inflación, por lo que subir las pensiones alrededor de esta cifra no puede definirse como congelación, y además ha insistido en que las pensiones "van a subir en España". 

En cualquier caso, Montoro ha adelantado que los Presupuestos Generales del Estado para 2015 recogerán un incremento del gasto en pensiones de entre el 3% y el 3,5%. Lo que signifa que habrá dos o tres "atracos" a la hucha de las pensiones.

Las pensiones ya subieron en 2014 un 0,25%, lo que se tradujo en un pequeño aumento en la nómina mensual de sus perceptores, de apenas unos euros, dependiendo del importe de la pensión. No ha tenido que sudar para deducir el "
dependiendo del importe de la pensión."

La reforma de las pensiones llevada a cabo por el Ejecutivo desvinculaba estas prestaciones del IPC, estableciendo un suelo del 0,25% y un techo del IPC más 0,50%, de modo que las pensiones no pueden ni subir ni bajar por encima de esos valores. Los pacto de Toledo dice que las pensiones se tienen que revalorizar de acuerdo al IPC, a excención de que los índices de la economía estén  por debajo del 30% de los previsto, o sea, admite que España va mal.

La fórmula tiene en cuenta tanto la inflación como los ingresos y gastos del sistema cada año, y los déficit o superávit del propio sistema de la Seguridad Social tomando como referencia las medias de varios ejercicios para modular los datos y evitar cambios bruscos en el sistema. ¡¡¡Superávit la SS¡¡ Es para enfadarse.

Meanwhile, another victim bravely described the harrowing moment she had to phone her parents on her birthday night out to tell them her skin was 'coming off'.
Collins, of Broxbourne, Hertfordshire, was convicted of five counts of causing GBH with intent and nine counts of assault occasioning ABH, relating to 14 revellers. 
During the sentencing hearing at Wood Green Crown Court, the judge ruled that Collin was 'dangerous' - meaning he will serve at least two-thirds of the jail term.
His family wept and shouted 'love you, Arth' after the sentence was delivered by the judge. He winked at his family as he was led to the cells.
Judge Lucas said: 'Your case has attracted a great deal of public interest.
'This is because what you did at the Mangle club on Easter Sunday evening was a despicable act.
'The conclusion I have come to is that you deliberately carried strong acid into that club to use when the need arised. The CCTV showed the wholly cowardly nature of the attack.
'Mr Collins' contrived defence is in my judgment significant. It shows him to be an accomplished and calculating liar.'
Rejecting an apology in a letter by Collins, the judge said: 'It was a hollow sorry - not for what he had done, but for the effect of his actions.
'He has expressed not the least remorse for carrying and using a highly corrosive acid.
'The injuries must have been extremely painful and utterly terrifying.'
The judge added: 'My very clear impression is that the security arrangements within the club venue were extremely poor.' 
At his sentencing hearing on Tuesday, the court heard Collins had threatened a similar attack on a former partner's mother.
He received a caution for racially aggravated harassment for ringing the woman in the middle of the night and threatening her with an acid attack and to have her raped.

The pair have previously told of their close friendship and Ferne recently praised Mr Argent in her documentary Ferne McCann: First Time Mum.
McCann visited acid attacker Collins in jail while he was awaiting sentencing, but told him that was the last time she would do so. 
Speaking to the Sunday People last month, Miss McCann said: 'I thought it was important that Arthur see Sunday and see exactly what his actions have led to him missing out on.'
'I strongly feel for the innocent people hurt that night and I in no way condone violence as I have already made clear.
'It was a difficult decision to take Sunday into that environment but I felt I needed to confront him about a number of things, which I have now done.'
